Terms and Conditions

This document (hereinafter "Terms and Conditions") regulates the access and use of the User of the services provided by JELOU, through the web portal made available by JELOU to its Users (hereinafter, the "Platform"). The terms and conditions indicated in this document will be applicable to any act and contract executed or entered into between any user and JELOU.

The Platform

The Platform is a virtual space composed of an electronic portal that displays information about JELOU. JELOU is a software as a service that provides various tools to companies to create a digital service or business without having a mobile application or website that operates from a Virtual Assistant in a Chat. Among these tools are the following:

  • Multi-Agent Panel
  • Chatbot
  • ChatApp Builder
  • Datum
  • Marketplace
  • Analytics or Dashboard

Definitions

JELOU:

We are a platform that allows creating any digital solution operating 24/7 through virtual assistants with Artificial Intelligence, allowing you to digitize your business without the need to develop an application.

Platform:

Electronic portal enabled to display JELOU's services and/or products.

Users and/or Clients:

Natural or legal person, with legal capacity to contract, who enters the Platform and makes use of the Platform's services with the possibility of acquiring the goods that JELOU offers through it.

Tools

Multi-Agent Panel:

Tool that allows connecting several human agents to a Help Desk to attend to user requests coming from any social network, the main ones being: WhatsApp, Facebook, Instagram, Twitter; additionally, the Multi-Agent Panel allows adding Chats from internet portals or mobile applications. The panel contains a CRM that allows the agent to automatically store important user information.

Chatbot:

Tool that allows connecting a company's user with cloud services for quick attention and obtaining information that usually exists in company databases or systems.

ChatApp Builder:

"No-Code / Low-Code" tool to build an entire digital system that receives and delivers data from a Chatbot or Virtual Assistant.

Datum:

Component that allows companies to store information about the system they want to create, their users, business rules, process states, and any new structure that allows adding more functionality to their system in a short time.

Marketplace:

Platform component that connects software developers or software companies that create code blocks or graphical interfaces and publish them in this section.

Analytics or Dashboard:

Customizable graphs that a company can create from information stored in DATUM or from their Chatbots' interactions.

Terms of Use

Account Management

Each client has, through their account, access to two admin users within the Platform. More users can be invited for the agent role who can respond to chats in the Multi-Agent Panel tool when they are referred by the system or by the Chatbot.

User Roles

The different user roles are: Monitor, Operator, Admin, Super Admin.

Service Charges

JELOU manages several services that, depending on the type of client or convenience based on advance discounts, are billed at the end of the month or through a pre-payment system before using JELOU's services.

The different payment methods include:

  • Fixed monthly subscription
  • Setup or Implementation Fee
  • Percentage commission and Transaction fee for sales
  • Successful or failed transaction fee for external systems or providers
  • 24-hour conversation sessions
  • Storage and Data Structures
  • Custom or additional modules
  • Consulting and Training

Service Guarantees

JELOU does NOT guarantee:

  • The proper use of Chatbot training data
  • The proper use of user permissions or roles
  • The proper use of keys to access the platform as users

JELOU DOES guarantee:

  • The proper operation to create, design and manage Virtual Assistants
  • Data protection under the Organic Law on Personal Data Protection
  • The persistence of digital knowledge created for Chatbots
  • Independent infrastructure and SLA compliance

Intellectual Property

Users must respect the integrity and inalienability of the Platform and all intellectual property rights included in the Platform as a whole or in each of its elements.

Personal Data Protection

In accordance with the Organic Law on Personal Data Protection, published in Official Registry supplement No. 459 of May 26, 2021, the processing of Users' personal data will be subject to JELOU's Privacy Policy or Notice, which can be reviewed at /privacy

Internal Communications, Customer Service, Claims and Inquiries

JELOU provides customer service via Chat, email and phone depending on the individual contract with each client.

If Users wish to register any complaint, claim or inquiry about JELOU's products and/or services, they can do so through our email help@jelou.ai

Modification of Terms and Conditions

JELOU may make changes to the terms and conditions, in accordance with modifications or requirements in the applicable regulations, or due to adjustments and improvements to the Platform.

Applicable Legislation

These Terms and Conditions are governed by and construed in accordance with the laws in force in the Republic of Ecuador, subject to the competence and jurisdiction of the Judges and Courts of the canton of Guayaquil, Ecuador.
