This privacy policy (hereinafter, the "Privacy Policy") aims to inform how JELOU S.A. processes the personal data it collects through its website https://www.jelou.ai (hereinafter, the "Website") or through its computer program Chatbot (hereinafter, the "Chatbot") and https://apps.jelou.ai/ (hereinafter, the "Apps"). With these policies, we want to comply with the Organic Law on Personal Data Protection published in the Fifth Supplement of Official Registry No. 459 dated May 26, 2021, its General Regulation of application, and any other regulations that may be applicable regarding personal data protection.

2. What is the identity and contact information of the Data Controller and Data Protection Officer?

Jelou S.A. (hereinafter JELOU), a company of Ecuadorian nationality, with Unique Taxpayer Registry No. 0992939478001, with registered office in the city of Guayaquil, is the Data Controller of your personal data under this Privacy Policy, therefore it is committed to compliance with its legal obligations and to protect your personal data.

3. What are the purposes and legal bases for processing your data?

JELOU may process your personal data for the following purposes:

• Develop service delivery processes, customer service, data processing.
• Processing and management of end-user transactions.
• Provide our services and products and comply with the obligations contracted by the data holder.
• Conducting tests in development and production of the dataset authorized by the client or prospect's data controller.
• Offer through own means or jointly with third parties information about new product launches, services, plans, promotions, events and/or benefits.
• Additional information that benefits the operation, support, maintenance, updates, warranty of our products or services in case of incidents, inconveniences, requirements or failures.
• Comply with the notification of information of interest when requested, including responding to your PQR (requests, complaints and claims).
• Study and store information associated with requests for any of our products that as a client or future client we need to know for the commercial relationship.
• Sending communications related to Jelou's commercial activities, news and useful information for our company, products, offers, news, event invitations, job offers, advertising, publicity and/or surveys about our products or services and/or the products and services of our business partners.
• Carry out collection activities related to obligations contracted by the holder.
• Processing of usage data of our products and/or services for statistical, marketing or relational analysis purposes.
• Processing of data for research, innovation, marketing, user consumption behaviors and development of new products and/or services.
• For the determination of pending obligations, consultation of financial information and credit history and reporting to information centers of unfulfilled obligations, regarding their debtors.
• Other activities related to the corporate purpose that necessarily must use the information or personal data of clients, prospects, or partners and other people related to any of our products and/or services and/or our organization.
• Export this information abroad, in case the hosting used is not located in Ecuador, within the legal guidelines and those determined by the control entity.
• Provide the online buying and selling service on the JELOU platform.
• Carry out systematic evaluations of personal aspects and behaviors of its users within the website, such as the development of profiles, trends and consumption habits, seeking a duly dissociated or at least anonymized treatment of this data, always attending to the security measures, principles and limitations for such purpose, provided in the Law.
• Contact through [phone calls, SMS, emails or other equivalent means], to send you advertisements, promotions, discount opportunities, general information.

4. What types of processing do we perform?

In general, with the aim of fulfilling the purposes we have indicated, and thus being able to provide our services to clients, web users and/or leads, JELOU may process the following categories of personal data:

• Identifying and contact data of a personal and/or professional nature;
• Navigation, traffic and/or metadata; and,
• Data about user behavior within the website, ChatBot and/or Apps platform.

5. What is the retention period we have considered for processing your personal data?

Your personal data will be kept as long as they are necessary to fulfill the purpose for which they were collected, therefore, once they are no longer necessary for the purposes for which they were collected, we will stop processing them.

In case you have given us your consent for processing, we will keep them until you revoke the consent

6. Do we store your personal data in any database?

Yes, Jelou stores the personal data provided and collected through the website in the personal database called "WEB USERS". Likewise, the personal data provided and collected through the use of the Chatbot is stored in the personal database called "CHATBOT USERS". As well as the personal data provided and collected through the use of the Apps platform is stored in the personal database called "APPS USERS".

7. Will JELOU use your data for other purposes and/or subsequent processing?

In exceptional cases, JELOU may process your data for the following purposes:

• Attend information requests from administrative or judicial authorities by virtue of requirements and orders in the exercise of their functions and the scope of their powers provided by Law.
• Attend requests from administrative authorities aimed at subsequent processing of data for historical, statistical or scientific purposes, provided that such data are duly dissociated or at least anonymized.
• In general, attend information requests by virtue of relevant legal provisions.

8. Do we communicate your personal data or perform international data transfers?

Your personal data, in general, is not shared with third parties. However, JELOU could share your data in the following cases:

• In case you have provided us with your information to contact you and offer you our services, we could share your data with our CRM system provider and thus be able to schedule appointments, calls, messages, etc., and in general be able to have an organized and personalized database.
• Attend information requests from administrative or judicial authorities by virtue of requirements and orders in the exercise of their functions and the scope of their powers provided by Law.
• Attend requests from administrative authorities aimed at subsequent processing of data for historical, statistical or scientific purposes, provided that such data are duly dissociated or at least anonymized.
• In general, attend information requests by virtue of relevant legal provisions.
• In the context of an audit, whether accounting, computer, personal data protection, etc. Likewise, we could share it with our accountants, lawyers and in general within the framework of services necessary for the good operation of the company and its legal and regulatory obligations.
• We could also share your personal data in case we are in any negotiation of sale of shares, mergers, acquisitions, spin-offs or any other form of company structuring, for which the respective confidentiality agreements will be signed.

9. What are the consequences of not providing us with your personal data or providing us with incorrect or inaccurate data?

If you refuse to provide your personal data, or provide incorrect or inaccurate data, JELOU will not be able to fulfill the purposes described above and the quality and manner of execution of the services we provide you will be compromised.

10. What rights do you have as a holder and how can you effectively exercise them?

As a Holder, you have the right to be informed, to access your data, to request its secure deletion, to request its rectification and updating, to object to the processing, to require the limitation of the processing, to have the processing suspended in cases duly established in the current legal regulations, to the portability of your data and not to be subject to a decision based solely on automated assessments and other rights enshrined in the Law.

11. How can you effectively exercise your right to the portability of your personal data?

At your express request, JELOU may return your personal data to you, in a compatible, updated, structured, common, interoperable and machine-readable format, preserving its characteristics, or deliver them to another controller that you decide, as long as it is technically possible, otherwise your personal data will be delivered directly to you.

12. Do we perform automated assessments and decisions, including profiling with your personal data?

JELOU may perform systematic evaluations of personal aspects and behaviors of its users within the website, such as the development of profiles, trends and consumption habits, seeking a duly dissociated or at least anonymized treatment of this data, always attending to the security measures, principles and limitations for such purpose, provided in the Law.

13. What security measures do we have?

JELOU adopts the necessary security measures to guarantee the protection of your personal data in order to prevent its alteration, loss, processing and/or unauthorized access, taking into consideration the nature of the information and the risks to which they are exposed. To protect your personal data, in JELOU we strictly comply with what is established in the Law and its Regulation.

JELOU expressly reserves the right to modify, update or complete this Privacy Policy at any time. Any modification, update or extension produced in this policy will be immediately communicated through the Website.
